Unpaid internship at a startup – legal?

http://ift.tt/eA8V8J

Hi there, I’m a student who recently received an e-mail for an unpaid internship at a startup. Nothing about equity has been discussed, but they did claim that they’ll receive funding soon and I should expect at least minimum wage after that.

Can I expect this startup to stick by its word, or should I be prepared to potentially lose out on being paid? What’s the best way that I can protect myself in the case that I don’t ever get paid for the hours I work? Should I log my hours for everything I do before funding is secured, so that when I do get paid, I can keep track of what I’m owed?

EDIT: Thanks everyone for the quick responses! Really appreciate some of these insights. For reference, I’m in Southern California and so is the startup, so I’ll be sure to take a look at some of the rules here. Thanks again, everyone!
